European Court of Human Rights to Consider Azerbaijani Citizen’s Lawsuit against Government

Azerbaijan, Baku /corr. Trend K.Ramazanova / The European Court of Human Rights will consider and make a judgment on the lawsuit of Latifa Efendiyeva on 25 October, a source stated in the European Court on 23 October.

The applicant, Latifa Efendiyeva, is an Azerbaijani national who was born in 1955 and lives in Baku. In December 1993 she was dismissed from her job as Head of the Republican Maternity Hospital.

Relying, in particular, on Article 6 § 1 (right to a fair hearing), Article 13 (right to an effective remedy) and Article 1 of Protocol No. 1 (protection of property), she complains that a court judgment, which ordered her reinstatement to her former post and payment of compensation for wrongful dismissal, was not enforced in good time.

The Baku City Court, where Efendiyeva made an appeal with regards to the Health Ministry of Azerbaijan, made a judgement on illegality of the Health Ministry's decision and re-appointment of Efendiyeva to her previous job. However, the Health Ministry formerly headed by Ali Insanov, who is currently accused of the corruption, did not implement the judgment.

Up to now, the European Court satisfied appeals of the six Azerbaijani citizens against the Government.
