Judge Powers Stopped in Connection with Corruption in   Azerbaijan (edited)

Azerbaijan, Baku, 20 February / Trend corr. K.Zarbaliyeva / The powers of the judge at Surakhani District Court of Baku were suspended prematurely.

The powers of Judge Latif Nabiyev were suspended as he faces charges for corruption in connection to abusing his position and status at the decision of the Court-legal Council.

The information source informed Trend that the reason for Nabiyev's premature cessation of powers was because of a decision on a civil dispute that he considered.

During consideration of the civil case involving a construction company and individual, Nabiyev purchased an apartment for a member of his family at a low price and made the decision in favor of the company.

Answering the question if this case was the main reason for Nabiyev's dismissal, experts stated that corruption is a crime. This case will be approved by a court decision.

The Court-legal Council must suspend the judge's powers prematurely after the Court makes its decision, Intigam Aliyev, the lawyer, considered.

Lawyer Rashid Hajili believes that every corruption fact should not be assessed as a crime. "I cannot understand the definition that Nabiyev faces charges for corruption in connection to abusing his position and status. This is a very serious charge and should be proven in court," Hajili stated.

The Court-legal Council instituted disciplinary proceedings against 75 judges. About 50 judges have been charged so far. The powers of three judges were stopped prematurely.

Before, Nabiyev was a judge in the Appeal Court. The Court-legal Council appointed him judge of Surakhani District Court.

About 30 judges were dismissed at the decision of the Council from 28 July 2007 due to the end of their term in the position.
