Justice Ministry: Majority of unexecuted judgments related to debt non-payment in 2009

The main reason for non-fulfillment of judgments in connection with the non-payment of debts is the lack of property in debtor, Justice Ministry's Central Bailiffs Department's head Khanlar Zeynalov told Trend News today.

In Azerbaijan, majority of unexecuted judgments are related with non-payment of debts in 2009.

The main reason for non-fulfillment of judgments in connection with the non-payment of debts is the lack of property in debtor, Justice Ministry's Central Bailiffs Department's head Khanlar Zeynalov told Trend today.

"In such cases, the debtors can not be made criminally responsible", he said.

In 2009, the department received 114,229 documents of execution, which is 12.29 percent more compared to 2008. Zeynalov said that 98, 806 cases are related to civil, economic disputes and administrative offenses of judicial and other bodies, and these decisions have been executed by 85 percent, Zeynalov said.

The rest part is judgments related with application of penalties which are not related deprivation of liberty.

Majority of judgments related to aliment, land disputes, eviction from an apartment, moving to an apartment, debt payment, compensation for damages as a result of a crime, Zeynalov said.

Zeynalov thinks progress is expected in the matter of execution of judgements relating to the vacation of apartments in which IDPs resided.

"During 2009, over 550 judgments related to the eviction from the apartment were executed. About 900 decisions were executed on the issue of resettlement in apartment. Most of these cases related to the apartments, which misappropriated by IDPs", Zeynalov said.

In 2009, Department has received 25,000 judgments related of aliment payment. Over 3700 of them have been executed in connection with reaching of a child to 18 years of age. About 22,000 cases are under execution.

Compared to 2008, the number of cases on aliment increased by 4,000.

In 2009, according to court decision 819 people were involved to administrative responsibility for payment evasion, and criminal cases were filed towards 125 people.

In 2009, the amount paid by legal and physical entities increased by 81.14 per cent and amounted to over  38 million manats as a result of execution of executive documents.
