Constitutional Court to consider Baku Court of Appeal's request

Baku Court of Appeal sent a request to the Constitutional Court (CC) in connection with the interpretation of articles 153.2, 154.4, 156.2 and 157.5 of the Criminal Procedure Code.

Baku Court of Appeal sent a request to the Constitutional Court (CC) in connection with the interpretation of articles 153.2, 154.4, 156.2 and 157.5 of the Criminal Procedure Code.

These articles establish the right of the accused and his advocate to appeal to the court to replace the arrest to house arrest, CC told Trend .

The law has no provision that the courts can not take the initiative to replace the arrest to house arrest.

Baku Court of Appeal noted at the request that there is sometimes ground for replacement arrest to house arrest, but in that case defending side does not act with the appropriate application.

Baku Court of Appeal has asked the CC in its request to interpret those articles of the Criminal Code in terms of availability in the court's authority to decide on the replacement of the arrest to house arrest in case of sufficient reason.

Baku Court of Appeal's request has been received and it will be considered at CC April 20.
