Forest Warden Illegally Fired Demands Compensation from Azerbaijan Ecology and Natural Resources Ministry

Zarbaliyeva / The European Court on Human Rights' fourth decision against Azerbaijan regarding the petition by the former director of the establishment responsible for the preservation and restoration of Ismayilly region's forests, Bahram Tarverdiyev, will take place in September.

On 16 July, Tarverdiyev reported to Trend that the day before he had been informed of the fulfilment of his petition by the European Court. Under the decision of the European Court on Human rights on 22 June Tarverdiyev was appointed as an engineer on the preservation and protection of forests at the aforementioned establishment.

From 1975 to 23 May 2001, Tarverdiyev was in the office of the director of the establishment on preservation and restoration of Ismayilly region's forests. For three months he did not go to work due to health problems. The Ecology and Natural Resources Ministry made the decision to dismiss him. On that occasion Tarverdiyev applied to the Narimanov District Court of Baku demanding that he be reinstated in his employment. Under the resolution of the Court dating 21 August 2001 he was to be reinstated, but the Ministry did not fulfil the court's decision.

Two years ago Tarverdiyev applied to the Yasamal District Court of Baku demanding payment of his salary for the period of the leave. "They said to me in the Yasamal Court that the case will be considered after a decision by the European Court is made. The resolution of the Narimanov Court regarding my reinstatement to work did not cover the issue of compensation for the period when I did not work. They said to me at the Court that I could initiate an action in this connection," Tarverdiyev said.

In his appeal to the European Court, the plaintiff demands restoration of his rights stipulated in Article 6 (right to just legal investigation) of the Convention on Human Rights.
