Azerbaijan, Baku / Trend corr. К.Zarbaliyeva / No juridical procedures are observed during the purchase and sale of apartments in newly constructed buildings. Formal contracts are concluded between persons wishing to purchase or sell apartments in buildings which are still in construction, Rashid Hajili, the lawyer, said to the Trend Agency on 3 September. This problem must be resolved by the Government.
Both parties, those selling the buildings and those purchasing these apartments trust each other. The Citizens pay money and receive cheque. If the seller of apartment is not able to return the sum then the Government has the right to interfere.
The building company should invest an obligatory fee in the bank after which the company may then begin construction work. Such guarantee must be compulsory in all spheres. Protection of citizen's rights in such cases is the duty of the Government," Hajili said.
Absence of a general bill in the area of construction creates problems in regulating relations in this sphere. There exists a Construction Code in certain countries. We have no similar Code in Azerbaijan, which causes certain problems in THE construction sphere, Hajili noted.
Construction companies are responsible for the people who have accidents which includes compensation.
By purchasing apartments without preliminary juridical procedures, causes a risk to the buyer. The government theoretically is responsible for incidents during construction as they must have the Government's permission before constructing a building, Hajili added.
