Azerbaijan is changing the rules of placement of outdoor advertising and its payment.
This issue was included in the changes proposed to be made in the Law on Advertising, which were discussed at the plenary session of the Azerbaijani parliament.
According to the changes, Article 26.2-2 will be as follows: “To obtain permission for placement of outdoor advertising, the advertising distributor must also enter into an agreement on the use of property with the owner of the advertising medium on which the advertisement will be placed, or with the owner (or manager) of the immovable property on which the advertising medium will be placed.”
“In case of placing an advertising medium on immovable property located in municipal area, the advertising distributor must pay the amount agreed between the municipality and the structure created by the relevant executive body.”
Moreover, the paragraph 26.2-3, which is being added to the law, is as follows: “For the placement of outdoor advertising, the advertising distributor pays the duty to the structure created by the relevant executive body in accordance with article 35.3.”
According to the changes proposed to be made in Article 26.8, the boards (inscriptions) placed at the entrance, the walls of the relevant service facilities, trade or other facilities, which are pointing to the name, affiliation, occupation, address and kind of activity of the mentioned facilities, are not seen as advertising.
Article 35.3, which is being added to the law, is as follows: “The amount of payment for the placement of outdoor advertising and the procedure for calculating this amount is determined by the relevant executive body.”
"Taking into account the requirement in the first sentence of this article, the issues related to the payment for the placement of outdoor advertising are included in the authorization agreement concluded with each advertising distributor envisaged in article 26.2.”
The bill was prepared to clarify the procedures for obtaining permission to place outdoor advertising, regulate the issues related to the price for outdoor advertising and the procedure for its payment.
The bill was put to a vote and passed by a majority vote.
