Office of the Prosecutor of Georgia begins retrial of the murder of the manager of the Finance Company "Telasi", Nika Lominadze, in 2002 in the light of new circumstances.

According to the head of one of the departments of the general prosecutor's office, David Nikolashvili, report of experts' examination carried out in the U.S. wasn't considered during legal investigation, what casts doubt on the guilt of the convicted for murder.

For authentication of the existing evidence in the case, the prosecution begins investigation under fraudulent use of official authority.

According to Nikolashvili, despite existing report of experts' examination, the lawyer of the accused George Gvichiani, Gela Nikolaishvili sent a cigarette butt and fingerprints seized at the crime scene for re-examination in the U.S. However, the conclusion of American experts did not coincide with the examination conducted in Tbilisi, according to which the cigarette butt and fingerprints prove the presence of the accused at the scene.

"Since during the process, the public prosecutor's office possessed this evidence, which wasn't presented to the court in the fullness of time, we will give them to Gvichiani's lawyer to petition the court to review the case in the light of new circumstances," David Nikolashvili said.

However, the main spokesman for the prosecutor's office apologized before Nika Lominadze's family for reminding the painful topic for them and informed them that the murder still remains unsolved.

"Prosecutors must check all the doubt and establish the issue. In order to find out why the expert report was not presented to the court, the prosecution decided to start criminal proceedings and investigation under fraudulent use of official authority", David Nikolashvili said.

Gia Gvichiani, Nodar Gvichiani, Nika Chemiya, Avtandil Kherkeladze and George Papashvili were convicted of murder of Nika Lominadze. Procedural agreements were signed with other figures involved in the case. Gia Gvichiani, who held a high position in the same Telasi company, and Nika Chemiya are sentenced to indefinite detention.
