Britney Spears' Rejected 'Attorney' Appeals Court Ruling

( CM ) - The lawyer who claims to represent Britney Spears has appealed the ruling giving the singer's father control of her estate.

Jon Eardley, a New York-based attorney, was previously ruled to have no authority to represent the Toxic star and failed in his attempt to move the case regarding the conservatorship of her estate from a district to a federal court.

Eardley had filed a complaint in the US district court on her behalf, alleging that the temporary conservatorship of Britney's estate by her father James was a "violation of civil rights".

But despite his first failure, Eardley has now filed an appeal to challenge the conservatorship ruling on the grounds that the singer was not given the five-day notice period required by California state law before control of a person's estate is altered."The record shows no legitimate grounds for dispensing with the 5-day notice requirement ... nor any finding by the court of good cause for dispensing with the 5-day notice," said the filing, according to the Reuters news agency.

Eardley's spokesman Michael Sands is also the representative of Sam Lufti, Britney's former manager and confidante, against whom a restraining order has been issued.

It was also revealed this week that Britney is to guest star in US sitcom How I Met Your Mother.

Neil Patrick Harris, who stars in the show, said he was "shocked" to hear of the 26-year-old's cameo appearance.

"It will be very unlike any Britney we have seen before, and we have seen a lot of Britney recently," he told Entertainment Tonight, referring to the troubled starlet's constant appearances in the tabloid press in the last year.

"What if she shows up on set and she is absolutely, totally normal and that whole thing has been a big ruse?" he asked.

"She is smoking a cigarette and [says], 'Oh yes, it is all a big bit. I have a master plan.'"
