BAKU, Azerbaijan, June 27. The dissolution of Azerbaijan's Parliament and the calling of the early election are in line with the Constitution, decided the meeting of the Plenum of Azerbaijan's Constitutional Court regarding the President’s request on the conformity of parliament's dissolution with the Constitution, Trend reports.
The session reviewed the request from the President of Azerbaijan regarding the constitutionality of dissolving the Milli Majlis (Parliament) and calling early parliamentary elections based on Resolution No. 1174-VIQR of the Milli Majlis dated June 21, 2024, "On the Appeal to the President of the Republic of Azerbaijan to Call Early Elections to the Milli Majlis of the Republic of Azerbaijan" in accordance with paragraph 1, part III, article 130 of the Constitution and article 7.1 of the Law "On the Constitutional Court."
The session was opened by the Chairman of the Constitutional Court, Farhad Abdullayev, who announced the composition of the Plenum and introduced the issue under discussion.
Representing the requesting side were Rustam Gasimov, Head of the Legal Policy Sector of the Legislation and Legal Policy Department of the Presidential Administration, and Araz Poladov, Head of the Legislative Development Sector of the same department. Representing the responding side were Farid Gadjiyev, Head of the Apparatus of the Milli Majlis, and expert Nasib Shukurov, Associate Professor of Constitutional Law at Baku State University's Faculty of Law and Doctor of Philosophy in Law.
After the speeches, the Plenum members retired to the deliberation room to decide on the agenda item.
Upon returning, Chairman Farhad Abdullayev announced the Plenum's decision.
The decision states that Resolution No. 1174-VIQR of the Milli Majlis, dated June 21, 2024, "On the Appeal to the President to Call Early Elections to the Milli Majlis," and the subsequent dissolution of the Milli Majlis by the President and the calling of early elections, are in accordance with article 981 of the Constitution.
The decision takes effect immediately, is final, and cannot be annulled, amended, or officially interpreted by any body or person.
With this, the session of the Plenum of the Constitutional Court was declared closed.
