Woman Dismissed for Pregnancy Re-employed

Azerbaijan, Baku, 22 September / Trend corr. K.Zarbaliyeva / The Azerbaijani Court made a decision to re-employ woman, who was dismissed because of pregnancy, the British company in Azerbaijan.

Rana Aliyeva has worked the head of the staff department at Baker Filly Azerbaijan co since February 2008 and got a salary of AZN 600. On 8 June the leadership of the company dismissed Aliyeva because of her pregnancy.

Irada Jafarova, Aliyeva's lawyer, said that the leadership of the company decided to dismiss Aliyeva for increase of the company's expenditures. A real reason of dismissal was woman's pregnancy, the lawyer said.

When Aliyeva knew that she was dismissed because of pregnancy, her health suddenly became worse and she could not go work within several days. When she submitted a certificate that she could not come to work for her treatment, the company told Aliyeva that she was dismissed on 9 June.

Aliyeva brought an action against the company at the Yasamal District Court of Baku for her re-employment, payment of salaries for the period, when did not work, as well as pay-off for moral damage and juridical expenditures. The plaintiff also demanded for the court's special decision to investigate illegal actions of the company's leadership.

The Yasamal District Court of Baku partially satisfied Aliyeva's suit.

The plaintiff's demands for payment for moral damage and making a special decision in respect of the company's leadership were rejected.

The lawyer said that the court made a special decision on immediate implementation of the court's verdict. If the decision is not carried out, a criminal case can be filed in relation to the company's leadership, Javadova said.
