Majority of court resolutions in Azerbaijan on apartment seizures by refugees not implemented: plenipotentiary

Majority of court resolutions in Azerbaijan seizure of citizens' apartments by refugees and internally displaced persons are not executed, Azerbaijani Plenipotentiary to the European Court Chingiz Asgarov said at the Baku conference on "Application of legal precedent of European Court on Human Rights to practices in Azerbaijan court".

"There are roughly 6,000 such cases in Baku and Sumgayit cities. Correspondences are being held with the European Court on about 20 cases," Asgarov said.

Azerbaijani citizens' property is inviolable, and necessary steps will be taken to ensure the property rights, said Chairman of the Supreme Court Ramiz Rzayev said at a news conference on the 2008 activity earlier.

"Houses will be built for refugees and internally displaced persons settled in Azerbaijani citizens' apartments in Baku and Sumgayit," Rzayev said.

The Azerbaijani courts passed resolution to evict refugees and internally displaced persons settled in the citizens' apartments, but the execution of these resolutions were postponed until the occupied Azerbaijani lands will be released.

"The European Court passed resolution against Azerbaijan Akimova's suit. The Azerbaijani courts must apply this as a precedent. However, enforcement of these decisions is not possible. Serious work is being conducted in this regard. A way out of the problem will be found in the near future," the plenipotentiary said.

Asgarov said postponement is granted to the courts to execute the resolutions to evict refugees and internally displaced persons from the occupied apartments. Meanwhile, an exact date and ground should be specified in this case.
