Half of decisions of European Court on Azerbaijan violates human rights

The European Court of Human Rights (ECHR) adopted 80 decisions on Azerbaijan, and violation of the European Convention on Human Rights and Fundamental Freedoms were found in about 55 percent of reviewed decisions. Azerbaijani government fined almost 400 thousand euros by decisions in which violation of the Convention revealed, Plenipotentiary of Azerbaijan to the European Court Chingiz Askerov told Trend.

That compensation rendered to plaintiffs on time, so there is no problem with payments, Askerov said.

"ECHR decision shall enter into force three months after adoption. If the compensation won't be paid on time, the interest accrued. We have no problems with compensation. Some 400,000 euros were paid as compensation until now," Askerov said.

As for the content of claims, then according to Askerov, among the actions taken by the production and actions on which a decision has already been made, most cases involving the eviction of IDPs from the places where they temporarily reside (the right to property), arrest and its extension as a preventive measure (right to liberty and security), and actions relating to the parliamentary elections in 2005. European Court made several decisions with regard to latter.

"These claims of violations were related to the denial of registration of candidates, or the cancellation of election results. There is no action related to elections in the production of the European Court" Askerov said.

Complaints about violations of the right to a fair investigation of the case very often associated with failure to provide the participation of the parties during the trial, Askerov said.
