Date of Legal Case on Appeal Initiated by a MP Determined

Azerbaijan, Baku/ Trend corr. S. Zarbaliyeva/ The date when the legal proceedings on the appeal put forward by Husseyn Abdullayev, whose immunity of deputy was deprived during the last extraordinary special sitting of the Milli Majlis (Azerbaijan's Parliament), has been determined. According to the Azerbaijan Court of Appeals, the appeal initiated by Mr. Abdullayev against the decision made by the Nasimi Court of Baku City will be considered in the Court presided by Judge Alakbar Guliyev on March 30, 2007.

Mr. Abdullayev's appeal is intended for the replacement of punitive measures chosen and applied to the Member of Azerbaijani Parliament to home arrest or release on a deposit.

A lawyer of Mr. Abdullayev, Kamandar Nasibov noted that on the basis of the appeal he had initiated, his client then passed medical investigation. However, no results have been reportd about this investigation.

Notably, Mr. Abdullayev's immunity of a deputy was deprived during the extraordinary special sitting of the Azerbaijani Parliament on the basis of the inquiry made by Zakir Garalov, the State Public Prosecutor on March 19, 2007. The Azerbaijani MP is currently kept in Pre-Trial Isolator 1 based in Bayil District of Baku City. The Investigation Department for Serious Crimes of the State Public Prosecutor's Office has already initiated a criminal case against Mr. Abdullayev on Articles 132 (assault and battery) and 221.2.2 (hooliganism) of the Criminal Code of Azerbaijan Republic. The investigation on the mentioned case is currently underway.
