European Court’s Resolution on Case of Azerbaijanis Democratic Party’s Chairman not Fully Implemented

К.Zarbaliyeva / The process to implement the resolution of the European Court on the case of Sardar Jalaloglu, the Chairman of the Democratic Party of Azerbaijan (DPA) regarding the restoration of his rights has not been completed as yet, Chingiz Askarov, the Azerbaijani representative of the European Court, said to the Trend Agency on 3 September. Presently, the resolution of the European Court is with the Supreme Court and the verdict of the Supreme Court should be unanimous.

The European Court made a resolution on the lawsuit of Jalaloglu on 11 January. Jalaloglu is charged with contravening Article 3 and must pay compensation of €10,000. The second part of the resolution on the case of the former commander of the Interior Troops, Fahmin Jajiyev, has already been fully implemented.

The Appeal Court of Azerbaijan has considered the lawsuit of Hajiyev. Repeated consideration of the lawsuit is impossible due to violation of the term of appeal. The European Court charged € 3,000 for moral damage and € 2,500 for expenditures by Hajiyev to the court.

The resolution of the European Court on pay contributions and the restoration of rights of Nabat Ramazanova and others has been implemented.

NGOs established by plaintiffs are taken under registration and € 4,000 paid is for damage.
