Kyrgyz HRAs demand to bring instigators of hooliganism at April events trial to justice

Kyrgyzstan's human rights advocates are requesting the Prosecutor General's Office to hold liable instigators of hooliganism occurred on the April events trial on July 13, 2011.

Adilet legal clinic applied again to the top prosecutor Aida Salyanova noting that earlier "following the results of first hearings we have repeatedly drawn attention of the leadership of the Prosecutor General's Office, the Ministry of Internal Affairs, the State National Security Committee that the course of hearings were followed by disorders preventing lawyers to fulfill their formal duties."

"We have sent applications about taking measures toward persons committed illegal actions in the court room. In November 2010, following the incident happened in the first day of the trial we had sent applications requesting to hold liable persons guilty in committing illegal actions through uttering insults toward participants of the trial," civil activists remind.

According to them, they haven't received any official response.

"The Prosecutor General's Office, the Ministry of Internal Affairs (MVD), the State National Security Committee (GKNB) had amazing understanding to persons insulting and threatening lawyers and defendants and statements humiliating national dignity of lawyers not titular ethnicity. Moreover, these bodies, called to ensure safety of citizens and prevent any violations of the law, justified illegal actions of victims by "strong emotions" allegedly "caused by the beginning of the trial and memory of April events." They don't take into account permanent stress conditions for lawyers, defendants and their relatives being in the court room caused by inadequate behavior of the aggrieved party," lawyers of Adilet legal clinic draw attention of the top prosecutor Aida Salyanova.

According to them, "MVD's and prosecutors' connivance and inactivity allowed the aggrieved party feeling the impunity and permissiveness to insult once more defence attorneys and defendants and inflict injures on one of defendants who is in hospital now on July 13, 2011."

Lawyers of Adilet think that the disorders during trial on April events, July 13, violates norms of the criminal legislation, including articles of the Criminal Code - Hooliganism, Impeding the justice, Impeding the professional activity of the lawyer, Contempt of the court.

"Abusers uttered threats, insults toward lawyers, defendants and translators. All facts of illegal actions committed by the aggrieved party are recorded and are in the possession of the court (the hearings are recorded)," they emphasize in the legal clinic.

Recall, the trial on April events has resumed today, July 18.
