Azerbaijani Supreme Court not approves Barmek Company President’s Appeal

Azerbaijan, Baku, 26 February / Trend corr. K.Zarbaliyeva / The Supreme Court of Azerbaijan did not approve the appeal of Barmek president and other six officials of the company, the lawyer Abbas Atakishiyev said to Trend .

Supreme Court returned the case to the Appeal Court of Baku for consideration.

Notably, the President of the above-mentioned company, Arabul is accused for eight years of imprisonment of Articles 179.3.2 of the Criminal Court of Azerbaijan Republic (misappropriation or dissipation), 308.2 (exceeding one's commissions), and 313 (service falsification). Based upon the above-mentioned accusations, the court ordered him not to leave the country.

Employees of Barmek limited company, the vice-president Omer Guner, director of technical Department, Vafa Agayev, alternate director of technical Department, Mahir Novruzov, the former manager, Chingiz Ibadov, chief of Financial Department, Valeh Abdullayev and chief of the Department on Exploitation of High Voltage Networks, Chingiz Abdullayev, and chief of the Service of Relay Protection, Askar Askarzadeh, were accused with the contravening Articles 179.3.2 and 313 of the Criminal Code of Azerbaijan.

The Prosecutor General does not agree with the sentence and appealed to toughen the sentence.

The investigation disclosed that employees of Barmek LLC misappropriated the sum of AZN143,940, which was collected from the consumers. An investigation revealed that based upon an agreement signed between the Azerbaijani Economic Development Ministry and Turkish company Barmek Holding, the rights to management of the Baku Electric Power Distributing Company (BakuElektrikShabaka OJSC) would have been passed to the Economic Development Ministry for a term of 25 years. According to the investment program stipulated in the agreement, the company was to invest $51 mln within five years, but actually did nothing in this respect.
