The Prosecutor General of Kazakhstan is taking a stand for tightening employers' liability for illegal use of foreign labour in the country. This was discussed at the regular board meeting of the General Prosecutor of Kazakhstan under the chairmanship of General Prosecutor Askhat Daulbayev, the office press service stated on Tuesday.

'Following the meeting it was decided to propose stopping any violations of the law and to improve the efficiency of legislation regulating to the involvement of foreign labour in the country, to the Kazakh government', the statement noted.

The analysis of the legal position in the employment field was presented during the board meeting.

'The analysis shows an increased penetration of foreign workers in the Kazakh labour market and at the same time a lack of proper supervision by the competent authorities on the use of foreign labour', the document stated.

As was said at the board meeting, violations in the issuance of permits for foreign citizens, use of false documents to obtain permits, involvement of foreign workers without qualifications have been registered with the connivance of local executive agencies.

'In addition, the requirement of Kazakh legislation is widely ignored and the rights of Kazakh workers are discriminated against', the report said.

According to the results of audits by prosecutor agencies, some 11 criminal proceedings were started with some 2230 people being brought to administrative responsibility.

Some 1396 permits have been withdrawn and some 271 suspended for foreign labour involvement and 238 foreigners were deported.

The report emphasised that the board recommended the adoption of effective measures aimed at tightening the responsibility of employers for following the laws on the involvement of foreign workers, illegal migration, as well as to address violations of the rights of Kazakhstan.

Reconsideration of the establishment of quotas for the country to attract foreign labour, consideration of granting the competent agencies in the field of employment, control functions of compliance of special conditions by employees for attracting foreign citizens as well as the introduction of a registry of unscrupulous employers have been proposed.
