First Vice-Chairman of Azerbaijan Democratic Party Commented Decision by European Court

Sardar Jaliloghlu, the First Vice-Chairman of the Democratic Party of Azerbaijan together with his lawyer, Fuad Aghayev, has stated, during the press conference being held in the Baku International Press Club, that he will do his best to bring those who tortured him to justice, Trend reports.

Mr. Jalaloghlu was arrested just after the presidential elections in Azerbaijan on October, 2003. He has appealed to the European Court for Human Rights. According to claims put forward by the applicant (Mr. Jalaloghli), on October 18, 2003 several masked police officers armed with machine guns forced their way into the applicant's home and arrested him. He was interrogated in connection with a demonstration which had taken place two days earlier at the Azadlig Square in the centre of Baku which had turned violent. He was later convicted on charges of organizing public disorder and of using violence against state officials and sentenced to three years' imprisonment. On January 11, 2007, the European Court pronounced judgment on the complaint of Mr. Jaliloghlu. His complained was provided and according to the decision made by the Court, the Azerbaijani Government must pay в'¬10.000 to him as a compensation for material and moral damaged he suffered.

His lawyer, Mr. Aghayev noted that the decision made by the European Court stated that on October, 2003, Mr. Jaliloghlu had been detained and sent to the pre-trail isolator of the Department for the Struggle against Organized Criminality of the Azerbaijan Interior Ministry, where he had been ill-treated. Upon investigation of such complaints in the European Court, the Court has acknowledged that ill-treatment had taken place on a number of occasions. The European Court determined that Article 13 of the European Convention was broken, and the rights of Mr. Jalilohghlu were brutally violated, admitted the lawyer.

According to him, further steps will include those persons who performed, planned and masterminded the tortures to his client, as well as investigators who did not check this fact properly, all the inquiry group and judges occupied with this case to be made accountable.

Mr. Jaliloghlu stated that he planned to appeal to the corresponding bodies to bring the following persons to criminal accountability for their ill-treatment of him, without having the facts: Gulnara Taghizadeh, a Judge of Narimanov District of Baku City, Mustajab Aliyev, the Chief of the Department for the Struggle against Organized Criminality of the Azerbaijan Interior Ministry, Samad Jafarov, an Officer of the above-mentioned Department, Vilayyat Eyvazov, the Deputy Azerbaijan's Interior Minister, Tahir Kazimov, the former Chief of the Investigation Department for Serious Crimes of the Azerbaijan Public Prosecutor's Ofice, Mansur Ibayev, a Judge of the Azerbaijan Court for Serious Crimes, as well as a group of judges of the Azerbaijan Supreme Court and Court of Appeals, etc. My decision is significant due to the fact that it should be made known that torture will not be tolerated. All international laws prohibit doing it, he stated.

The Democratic Party of Azerbaijan was established in 1991. The first Chairman of the party was Sardar Jalaloghli. After Adalyat (Equity), the Party's Chairman, Ilyas Ismayilov joined the Democratic Party in 1996, he was elected the Chairman of the Party. But after the Ecology Fund's joining the Democratic Party, the institute of co-chairmanship was founded (1998). Rasul Guliyev was then the Chairman of the Ecology Fund. Mr. Ismalilov and R. Guliyev then became Co-Chairmen of the Party. After Mr. Ismayilov founded the new Adalyat Party in 2000, Mr. Guliyev was chosen as the Chairman of the Party. However, since 1996, Mr. Guliyev has lived in USA. The Democratic Party of Azerbaijan is the opposition party to political bloc Azadlig, said Mr. Guliyev.
